06 new precedents officially applied from February 15, 2018

On December 28, 2017, the Supreme People’s Court issued Decision 299/QD-CA announcing 06 precedents approved by the Council of Judges on December 14, 2017.

Accordingly, the People’s Courts and Military Courts are responsible for researching and applying precedents in trials from February 15, 2018.

At the same time, Decision 299/QD-CA (effective from the date of signing) also announced the sources of the above 6 precedents as follows:

– Cassation Decision No. 01/2017/KDTM-GĐT dated March 1, 2017 on business and commercial cases of credit contract disputes.

– Cassation Decision No. 14/2017/KDTM-GĐT dated June 6, 2017 on business and commercial cases of disputes over goods purchase and sale contracts.

– Cassation Decision No. 17/2016/KDTM-GĐT dated November 10, 2016 on business and commercial cases of disputes over goods purchase and sale contracts.

– Cassation Decision No. 02/2011/DS-GDT dated January 17, 2011 on the case requesting cancellation of land use rights transfer contract.

– Cassation Decision No. 394/2012/DS-GDT dated August 23, 2012 on the land exchange contract dispute case.

– Cassation Decision No. 573/2013/DS-GDT dated December 16, 2013 on the case of property inheritance dispute.
